STANDARD TERMS AND CONDITIONS 

1. Introduction and Acceptance of Terms

These Terms and Conditions ("Agreement") govern the relationship between Health & Surgery Savior FZCO, a Free Zone Company incorporated and operating under the laws of the United Arab Emirates ("the Company", "we", "us", or "our"), and any individual, patient, or representative ("Client", "you", or "your") who engages our services.

By engaging with Health & Surgery Savior FZCO, signing a service agreement, making a payment, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by this Agreement in its entirety. If you do not agree with any part of these Terms and Conditions, you must not proceed with our services.

2. About Health & Surgery Savior FZCO

Health & Surgery Savior FZCO is a medical tourism logistics and coordination company registered as a Free Zone Company in the United Arab Emirates. The Company operates solely as a logistical coordinator and travel facilitation intermediary between Clients and independent medical professionals, hospitals, and healthcare facilities.

The Company's role is strictly limited to the following services:

  • Coordination and booking of travel arrangements (flights, ground transportation, airport transfers)

  • Hotel accommodation and lodging reservations

  • Scheduling and appointment coordination with independent medical providers

  • Pre-departure and arrival logistical support

  • General information and guidance throughout the Client's journey

  • Post-travel administrative assistance as agreed


The Company does NOT provide, supervise, or control any medical, surgical, clinical, or healthcare services whatsoever.

3. Scope of Services – Logistical Coordination Only

The Company expressly limits its role to non-medical, administrative, and logistical functions. Clients acknowledge and accept the following:

3.1 Services Provided by the Company

  • Travel planning and itinerary management

  • Flight bookings and transportation arrangements

  • Hotel and accommodation reservations

  • Coordination of pre-operative and post-operative logistics

  • Liaison and communication with medical providers on scheduling matters only

  • Provision of general destination information

3.2 Services NOT Provided by the Company

  • Medical consultations, diagnoses, or treatment plans

  • Surgical procedures or post-operative care

  • Medical advice of any kind

  • Nursing or clinical support

  • Pharmaceutical recommendations or prescriptions

  • Medical emergency response or management


For all medical services, Clients shall enter into a separate, direct agreement with the treating physician, surgeon, or healthcare facility. Health & Surgery Savior FZCO is not a party to and assumes no responsibility under any medical service agreement.

4. Medical Disclaimer and Limitation of Medical Liability

HEALTH & SURGERY SAVIOR FZCO IS NOT A HEALTHCARE PROVIDER, MEDICAL INSTITUTION, OR LICENSED MEDICAL PRACTITIONER. THE COMPANY DOES NOT PROVIDE MEDICAL ADVICE, MEDICAL SERVICES, OR CLINICAL CARE OF ANY KIND.

The Company shall bear no liability whatsoever for:

  • Any surgical outcome, medical complication, adverse reaction, or clinical result

  • The quality, standard, or adequacy of medical treatment received

  • Errors, negligence, or omissions on the part of any medical professional or healthcare facility

  • Any injury, disability, disfigurement, illness, or death arising from or connected to a medical procedure

  • Post-operative complications, infections, or long-term health consequences

  • Misdiagnosis, delayed diagnosis, or failure to diagnose by any medical provider

  • Any matters covered by or falling under the scope of the separate medical services agreement


All medical disputes, claims, or concerns must be directed exclusively to the treating physician, surgeon, or healthcare institution. By engaging the Company's services, the Client acknowledges that the Company has no authority over, and accepts no responsibility for, any aspect of the Client's medical care.

5. Separate Medical Services Agreement

Prior to undergoing any medical procedure facilitated through the Company's coordination services, the Client is required to enter into a separate written agreement directly with the treating medical professional or healthcare facility.

This separate agreement shall govern:

  • The nature, scope, and risks of the proposed medical procedure

  • Informed consent to treatment

  • Medical fees and payment terms to the provider

  • Post-operative care responsibilities

  • Medical liability and indemnification

  • Any warranties or guarantees provided by the medical provider


The execution of the separate medical services agreement is a prerequisite for the commencement of any logistical coordination by the Company. The Company shall not be liable for any failure by the Client to execute or comply with the terms of the medical services agreement.

6. Client Responsibilities

The Client acknowledges and accepts the following responsibilities:

6.1 Medical Fitness and Disclosure

  • The Client is solely responsible for ensuring that they are medically fit to travel and undergo any planned procedure

  • The Client must provide accurate and complete medical history, current medications, allergies, and relevant health information to both the Company and the treating medical professional

  • The Client agrees to follow all pre-operative and post-operative instructions provided by the treating physician

  • The Client must obtain independent medical clearance for travel from their own healthcare provider where recommended

6.2 Travel and Documentation

  • The Client is responsible for ensuring the validity of their passport, visa, and any other required travel documentation

  • The Client must comply with all applicable immigration, customs, and entry requirements of the destination country

  • The Client is responsible for obtaining appropriate travel insurance, including medical evacuation and repatriation coverage

6.3 Compliance with Arrangements

  • The Client must adhere to confirmed travel schedules, appointment times, and accommodation bookings

  • The Client accepts financial responsibility for any costs arising from their failure to comply with agreed arrangements

  • The Client must promptly notify the Company of any changes to travel plans, medical condition, or personal circumstances that may affect the arrangements

7. Booking, Payments, and Cancellations

7.1 Booking Confirmation

All bookings are confirmed only upon receipt of written acceptance by the Company and payment of the applicable service fee or deposit. The Company reserves the right to decline any booking at its sole discretion.

7.2 Service Fees

The Company's service fees cover logistical coordination services only. Medical fees, hospital charges, surgical fees, and any costs directly payable to healthcare providers are separate and are not included unless expressly stated in writing.

7.3 Cancellation and Refund Policy

  • Cancellations made more than 30 days prior to the scheduled travel date: eligible for a refund of the coordination fee less an administrative charge of 20%

  • Cancellations made 15–30 days prior to the scheduled travel date: eligible for a 50% refund of the coordination fee

  • Cancellations made fewer than 15 days prior to the scheduled travel date: no refund

  • Third-party costs (flights, accommodation, transfers) are subject to the cancellation policies of the respective suppliers and may be non-refundable

  • Medical procedure deposits or fees paid to healthcare providers are governed exclusively by the separate medical services agreement

7.4 Changes to Arrangements

The Company will use reasonable efforts to accommodate changes to travel or logistical arrangements requested by the Client. Additional charges may apply, and the Company cannot guarantee that all changes can be accommodated.

8. Travel Insurance

The Client is strongly advised and shall be responsible for obtaining comprehensive travel insurance prior to departure, including but not limited to coverage for:

  • Medical emergencies and hospitalisation abroad

  • Surgical complications and related treatment costs

  • Medical evacuation and repatriation

  • Trip cancellation and curtailment

  • Personal liability


The Company shall not be liable for any costs, losses, or damages that would have been covered by adequate travel insurance. Failure to obtain travel insurance does not diminish the Client's obligations under this Agreement.

9. Limitation of Liability

To the maximum extent permitted by applicable UAE law:

  • The Company's total liability to the Client for any claim arising out of or in connection with the provision of logistical coordination services shall not exceed the total amount of the coordination service fee paid by the Client to the Company

  • The Company shall not be liable for any indirect, consequential, incidental, special, punitive, or exemplary damages

  • The Company shall not be liable for any loss arising from delays, cancellations, or rescheduling by third-party service providers including airlines, hotels, or transport companies

  • The Company shall not be liable for any acts, omissions, negligence, or misconduct of independent medical professionals or healthcare facilities

  • The Company shall not be liable for any loss, theft, or damage to personal property during travel

  • The Company shall not be liable for circumstances beyond its reasonable control including but not limited to force majeure events, governmental actions, natural disasters, pandemics, or strikes

10. Force Majeure

The Company shall not be in breach of this Agreement and shall not be liable for any failure or delay in performance of its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, epidemics, governmental restrictions, labour disputes, or failure of third-party providers.

In such circumstances, the Company will use reasonable efforts to rearrange services and will communicate developments to the Client as promptly as practicable.

11. Privacy and Data Protection

The Company collects, processes, and stores personal data, including sensitive health-related information, solely for the purpose of providing logistical coordination services. All data is handled in accordance with the UAE's applicable data protection laws and regulations.

Personal data will not be shared with third parties except where necessary to fulfil the services described herein (e.g., airlines, hotels, medical scheduler), or as required by law. The Client consents to the use of their personal data for these purposes by entering into this Agreement.

12. Intellectual Property

All materials, content, documentation, and communications produced by Health & Surgery Savior FZCO are the intellectual property of the Company and may not be reproduced, distributed, or used without prior written consent.

13. Governing Law and Jurisdiction

This Agreement and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Any disputes arising from this Agreement shall first be referred to mediation. If mediation is unsuccessful within 30 days of a written request, disputes shall be subject to the exclusive jurisdiction of the competent courts of the UAE, or such arbitration forum as may be mutually agreed in writing by the parties.

14. Amendments

The Company reserves the right to amend these Terms and Conditions at any time. Updated versions will be made available to Clients and shall take effect upon notice. Continued use of the Company's services following notification of amendments constitutes acceptance of the revised terms.

15. Severability

If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the Agreement. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

This Agreement, together with the separate medical services agreement and any written service confirmation issued by the Company, constitutes the entire agreement between the parties with respect to the subject matter herein and supersedes all prior representations, understandings, and agreements.

CLIENT ACKNOWLEDGEMENT

By signing below, the Client confirms that they have read, understood, and agree to be bound by these Terms and Conditions in full, and acknowledge that Health & Surgery Savior FZCO acts solely as a logistical coordinator and bears no responsibility for any medical outcome.
